The Online Store and application of these terms
The Online Store is owned by Ruumik OÜ, registry code 14621467, VAT identification number EE102484867, registered office at Sõpruse 13a, Viiratsi, 70101, Viljandi, Estonia (hereinafter the Online Store). The Online Store can be contacted by email at info@ruumik.ee and by telephone at +372 525 0201.
These Terms and Conditions of Sale apply to consumers purchasing goods from the Online Store. A purchaser acting in the course of a business or profession may also be subject to terms agreed in an order, quotation or separate agreement.
Goods and prices
The description, price and availability of each item are shown alongside the item in the Online Store. The price displayed to a consumer includes the applicable value added tax.
The delivery charge and any other unavoidable charges associated with the order are displayed before the order is placed. The charges depend on the destination country, delivery method and order details.
If a price or other material information is incorrect due to an obvious technical error, the Online Store will contact the consumer. The Online Store may cancel the order if the consumer should reasonably have recognised the error.
Placing an order and conclusion of the sales contract
To place an order, the consumer adds the goods to the shopping cart, enters the required information, selects a delivery method and payment method, and checks the contents and total price of the order before submitting the order with an obligation to pay.
For an immediate-payment order, the sales contract is concluded when the payment is successful and the Online Store sends the consumer a payment confirmation or order confirmation. For an order paid by invoice, the sales contract is concluded and the goods are reserved when the Online Store sends the invoice to the consumer.
The goods will be dispatched after payment has been received, unless the Online Store and the consumer have agreed otherwise in writing.
If the ordered goods cannot be supplied, the Online Store will inform the consumer at the earliest opportunity and refund any payment received without undue delay, but no later than 14 days, unless the parties agree on substitute goods or a new delivery time.
Delivery
Goods are delivered to Estonia, Latvia, Lithuania and Finland. The delivery methods available for the order, their prices and, where possible, the estimated delivery time are displayed at checkout.
Goods in stock are normally dispatched within 1–2 business days after payment has been received. The carrier’s transit time is additional and depends on the destination country and delivery method.
The consumer is responsible for the accuracy of the delivery and contact details entered. The reasonable additional cost of redelivery caused by incorrect information may be charged to the consumer.
Right of withdrawal and return of goods
The consumer has the right to withdraw from a contract concluded in the Online Store without giving any reason within 14 days after receiving the goods. If an order is delivered in several parts, the withdrawal period begins upon receipt of the last part. The right of withdrawal does not apply to a legal person.
To withdraw, the consumer must send an unequivocal statement before the end of the withdrawal period to info@ruumik.ee or use the Withdraw from contract function in the footer of the Online Store. Use of the model withdrawal form published in the Online Store is optional. The Online Store will acknowledge receipt of an electronically submitted withdrawal statement on a durable medium.
The Online Store will provide the consumer with a return address or return code and practical return instructions. The consumer must return the goods within 14 days after submitting the withdrawal statement. Before receiving the instructions, the consumer must not send the goods to the Online Store’s registered office or bring them to the warehouse without prior agreement. Any delay by the Online Store in providing the instructions will not reduce the time available to the consumer for returning the goods.
The direct cost of returning the goods is borne by the consumer, except where the wrong goods or goods that do not conform to the contract are returned, or where the Online Store has agreed to bear the cost.
The Online Store will refund all payments received from the consumer, including the cost of the least expensive standard delivery method offered, no later than 14 days after receiving the withdrawal statement. The Online Store may withhold the refund until it has received the goods or the consumer has supplied evidence of having returned the goods.
The consumer may handle the goods only to the extent necessary to establish their nature, characteristics and functioning. If the handling exceeds what would normally be permitted in a physical shop, the consumer is responsible for the proven reduction in the value of the goods. Opening the packaging does not in itself exclude the right of withdrawal.
Where a statutory exception to the right of withdrawal applies to a particular product, the consumer will be clearly informed of the exception before placing the order.
Goods that do not conform to the contract
The Online Store is liable for any lack of conformity of the goods that becomes apparent within two years after delivery of the goods. If a lack of conformity becomes apparent within one year after delivery, it is presumed, in accordance with the law, to have existed at the time of delivery.
The consumer must notify the Online Store of the lack of conformity within two months after discovering it by writing to info@ruumik.ee. Where possible, the notice should include the order number, a description of the issue and relevant photographs or other evidence.
Where goods do not conform to the contract, the consumer may, subject to the conditions provided by law, demand in particular that the goods be repaired or replaced and, if this is impossible or unsuccessful, request a price reduction or withdraw from the contract.
The Online Store will respond to the consumer’s written complaint within 15 days. If the complaint cannot be resolved within that period, the Online Store will explain the reason for the delay and provide a new reasonable deadline.
The Online Store is not liable for a lack of conformity arising after delivery as a result of the consumer’s actions, improper use or storage, an accident, normal wear and tear, or failure to follow the instructions for use.
Personal data
The Online Store processes personal data related to orders in accordance with its Privacy Policy. The Privacy Policy and cookie information are available in the footer of the Online Store.
Resolution of disputes
Questions or complaints may be sent to info@ruumik.ee. The parties will attempt to resolve disputes through negotiation.
If no agreement is reached, a consumer resident in Estonia may refer the dispute to the Consumer Disputes Committee operating at the Consumer Protection and Technical Regulatory Authority: https://ttja.ee/en/consumer-disputes-committee. Proceedings before the Committee are free of charge for the consumer. The consumer may also apply to a competent court.
Applicability of these terms
An order is governed by the version of the Terms and Conditions of Sale that was in force when the order was submitted. The Online Store will send the consumer confirmation that the contract has been concluded and the applicable Terms and Conditions of Sale by email or on another durable medium.
The Online Store may amend these terms for future orders. Amendments do not affect contracts that have already been concluded.
